The term “partner” or “vendor” or “driver”or “third party transportation provider” or “third party” refers to the suppliers of Zooper.

Zooper considers itself and intends to be subject to the jurisdiction only of the courts of Pune, India.
TERMS OF SERVICES
Our Services constitute a technology platform that enables users of Zooper's mobile applications or websites provided as part of the Services to arrange and schedule transportation and/or logistics services with independent third party providers of such services, including independent third party transportation providers and independent third party logistics providers under agreement with Zooper or certain of Zooper's affiliates (“Third Party Providers”). Unless otherwise agreed by Zooper in a separate written agreement with you, the Services are made available solely for your personal and non-commercial use. You acknowledge that Zooper does not provide transportation or logistic services or function as a transportation carrier and that all such transportation or logistics services are provided by independent third-party contractors that are not employed by Zooper or any of its affiliates. Zooper functions as an intermediary/booking agent and electronic commerce operator.
TERMS OF SERVICES
Booking can be made online by filling up the booking form provided here or through phone booking. Payment can be made through any of the credit/debit cards, net banking or mobile walletsprovided by our payment gateway provider. Payments can also be made in cash or cheque directly to our customer service team or the vehicle driver. Booking can be made for any person other than card holder also. For that you need to fill up details of card holder for payment and details of user for booking. The use of credit card is totally safe, we use PayU Money payment gateway for online payments. We do not store your credit card information at our end.
A booking confirmation or failure voucher will be sent to the userover E-mail and/or Mobile Number when he completes the online or phone booking.
Producing the booking voucher to the driver is mandatory to avail the car rental services by Zooper. If this is not done it entitles the driver to refuse service delivery without any liability on us to refund the booking amount.
When a user produces the booking voucher, it implies that he/she has read and understood all terms and conditions mentioned herewith and agrees on all of them
The start and end distance in KMs will be calculated from and to Zooper rental location. Driver & car details will be sent by our team/systems approximately 2 hours before the pick-up time by SMS, email or any other medium. In some cases, the driver or partners of Zooper may also call in advance to reconfirm with the customer.
In case of non-receipt of driver and car details, customer needs to contact Zooper customer service team.
In case of any dispute with the driver the customer shouldimmediately report the incident to Zooper customer service team at +91 (0)20 400 40 400 or +91 83 8080 4000.
User can request for cancellation of a booking by contacting Zooper Customer service team at +91 (0)20 400 40 400.User must havean email confirmation from Zooper for the modification of the booking.Zooper may verify the user and booking details before accepting the cancellation request. Zooper may take up to 18 hours to provide a confirmation.
- If a user cancels the trip 24 hours prior to the pickup time, no cancellation fee would be charged
- If a user cancels the trip 12 hours prior to the pickup time, 10% of the total bill amount would be charged
- If a user cancels the trip 4 hours prior to the pickup time, 35% of the total bill amount would be charged
- If a user cancels the trip within 4 hours of the pickup time, 70% of the total bill amount would be charged
- Any cancellations after the scheduled pick up time is not allowed, 100% of the total bill amount would be charged as cancellation fee
All refunds will be processed into customer’s bank account within 7 working days. Customer may choose to leave a credit balance with Zooper that can be used for his/her next booking
BOOKING MODIFICATION POLICIES
User can request for modification of any booking by contacting Zooper Customer service team at +91 (0)20 400 40 400. User must havean email confirmation from Zooper for the modification of the booking. We may verify the user and booking details before accepting the cancellation request.Zooper may take up to 12 hours to provide a confirmation
- If a user requests for modification 24 hours prior to the pickup time, no charges would be applied
- If auser requestsfor modifications to a booking 12 hours prior to the pickup time, a charge of 10% will be applied
- If a user requests for modification of the booking 4 hours prior to the pickup time, 35% of the total bill amount would be charged
- If a user requests for modification of the booking within 4 hours of the pickup time, 70% of the total bill amount would be charged
RIGHT TO CANCELLATION IN CASE OF INVALID INFORMATION FROM USER
The User expressly undertakes to provide to Zooper only correct and valid information while requesting for any services under this agreement, and not to make any misrepresentation of facts at all. Any default on part of the User would void this agreement and shall disentitle the User from availing the services from Zooper.
In case Zooper discovers or has reasons to believe at any time during or after receiving a request forservices from the User that the request for services is either unauthorized or the information provided by the User or any of them is not correct or that any fact has been misrepresented by him, Zooper in its sole discretion shall have the unrestricted right to take any steps against the User(s), including cancellation of the bookings, etc. without any prior intimation to the User. In such an event, Zooper shall not be responsible or liable for any refunds, loss or damage that may be caused to the User or any of them because of such cancellation of booking or services.
The User unequivocally indemnifies Zooper of any such claim or liability and shall not hold us responsible for any loss or damage arising out of measures taken by Zooper for safeguarding its own interest and that of its genuine customers. This would also include Zooper denying/cancelling any bookings because of suspected fraud transactions.
USAGE OF THE MOBILE NUMBER OR EMAIL OF THE USER
Zooper may send booking confirmation, itinerary information, cancellation, payment confirmation, refund status, schedule change or any such other information relevant for the transaction, via SMS, email, instant messengers or by voice call on the contact number given by the User at the time of booking. Zooper may also contact the User by voice call, SMS or email in case the User couldn’t or hasn’t concluded the booking, for any reason what so ever, to know the preference of the User for concluding the booking and also to help the User for the same. The User hereby unconditionally consents that such communications via SMS, instant messenger and/ or voice call by Zooper is (a) upon the request and authorization of the User, (b) ‘transactional’ and not an ‘unsolicited commercial communication’ as per the guidelines of Telecom Regulation Authority of India (TRAI) and (c) in compliance with the relevant guidelines of TRAI or such other authority in India and abroad. The User will indemnify Zooper against all types of losses and damages incurred by Zooper due to any action taken by TRAI, Access Providers (as per TRAI regulations) or any other authority due to any erroneous compliant raised by the User on Zooper with respect to the intimations mentioned above or due to a wrong number or email id being provided by the User for any reason whatsoever.
FEEDBACK FROM USER & SOLICITATION
REPAIR OR CLEANING FEES
You shall be responsible for the cost of repair for damage to, or necessary cleaning of, Third Party Provider vehicles and property resulting from use of the Services under your Account in excess of normal “wear and tear” damages and necessary cleaning (“Repair or Cleaning”). In the event that a Third-Party Provider reports the need for Repair or Cleaning, and such Repair or Cleaning request is verified by Zooper in Zooper’s reasonable discretion, Zooper reserves the right to facilitate payment for the reasonable cost of such Repair or Cleaning on behalf of the Third-Party Provider using your payment method designated in your Account or raise a separate invoice for payment. Such amounts will be transferred by Zooper to the applicable Third-Party Provider and are non-refundable.
The Services are provided "As Is" and "As Available". Zooper disclaims all representations and warranties, express, implied or statutory, not expressly set out in these terms, including the implied warranties or merchantability, fitness for a particular purpose and non-infringement. In addition, Zooper makes no representation, warranty, or guarantee regarding the reliability, timeliness, quality, suitability or availability of the services or any services or goods requested through the user of the services, or that the services will be uninterrupted or error-free. Zooper does not guarantee the quality, services and any service or good requested in connection therewith, remains solely with you, to the maximum extent permitted under applicable law.
LIMITATION OF LIABILITY
Zooper shall not be liable for indirect, incidental, special, exemplary, punitive or consequential damages, including lost data, property damage, personal injury, lost profits related to, in connection with, or otherwise resulting from any use of services, even if Zooper has been advised of possibility of such damages. Zooper shall not be liable for any damages, liability or losses arising out of: (a). Your use of or reliance on the service or your inability to access or use the services; or (b). Any transaction or relationship between you and any third-party provider, even if Zooper has been advised of possibility of such damages. Zooper shall not be liable for delay or failure in performance resulting from causes beyond Zooper's reasonable control. You acknowledge that third-party transportation providers providing transportation services requested through some request of our product/service features may offer sharing of cabs. In no event shall Zooper's total liability to you in connection with the services for all damages or losses and causes of action exceed Rs5000.
Zooper's services may be used by you to request and schedule transportation, goods or logistics services with third party providers, but you agree that Zooper has no responsibility or liability to you related to any transportation, goods or logistics services provided to you by the vendor other than expressly set forth in these terms.
You agree to indemnify and hold Zooper and its officers, directors, employees and agents harmless from any and all claims, demands, losses, liabilities, and expenses (including attorneys’ fees) arising out of or in connection with: (i) your use of the Services or services or goods obtained through your use of the Services; (ii) your breach or violation of any of these Terms; (iii) Zooper's use of your User Content; or (iv) your violation of the rights of any third party, including Third Party Providers.
Zooper reserves the right to change the terms, conditions, and notices under which the Zooper websites are offered, including but not limited to the charges. The User is responsible for regularly reviewing these terms and conditions.
